FOR PARTICIPATION IN LeMar Jet Training s. r. o. COURSES

Applicable as of 10 February 2024

I. Definitions

LeMar Jet Training s. r. o. Location: LeMar Jet Training s. r. o. training facilities as listed on the LeMar Jet Training s. r. o. website. Training Course: courses offered by LeMar Jet Training s. r. o. The list of training courses is available on the LeMar Jet Training s. r. o. website. Course Date: the date of each Training Course as advertised on the LeMar Jet Training s. r. o. website. Course Fee: the price of participation in Training Courses, as defined on the LeMar Jet Training s. r. o. website at the time of registration. NB: Please note that Training Courses are subject to price indexation yearly. Training Course Materials: all course materials will be in principle provided in electronic/digital format and are not allowed to be copied or reproduced as per strict copyright laws. LeMar Jet Training s. r. o. Course Material is fully copyrighted. Participant: a person registered for a training course. Substitution: replacement of a participant for a training course. Course Transfer: an event in case a participant who has already paid the course fee wishes to attend the same training course on another course date and/or location. Governing Law: the laws of the Slovak Republic.

II. Applicability

1. These General Terms and Conditions shall be applicable for participation in training courses, at any LeMar Jet Training s. r. o. locations.
2. With respect to Training Courses provided outside LeMar Jet Training s. r. o. Location, if the provisions of the agreement concluded by and between LeMar Jet Training s. r. o. and the person or organization requesting the Training Course to be delivered outside LeMar Jet Training s. r. o. Location (‘requesting person’) differs from the provisions of these General Terms and Conditions, the provisions laid down in such agreement shall prevail. It is the responsibility of the requesting person to ensure that Participants are informed about the applicable provisions.
3. Any provision of these General Terms and Conditions that is inconsistent with the mandatory provisions of the Governing Law shall be null and void. The other provisions shall nevertheless remain valid. Instead of the void provisions, the Governing Law shall apply.

III. Registration for the training courses

1. Participants are required to register for the training courses online, via the LeMar Jet Training s. r. o. website or, when the Training Course is offered in co-operation with another organization, via the appropriate registration means of the organization concerned.
2. Registrations must be made no later than 24 hours before the scheduled start date of the Training Course, subject to seat availability.
3. All data the Participant wishes to be included on the invoice shall be indicated upon registration.

IV. Invitation Letters for Visa Purposes

1. It is the responsibility of the Participant to clarify if they are in need of a visa to enter the country where the Training Course is delivered and to check with the Embassy the procedure and duration of the visa application.
2. Upon request, LeMar Jet Training s. r. o. will provide the Participant with an invitation letter if the Course Fee is received in full by LeMar Jet Training s. r. o..
3. In the event the participant needs a visa for entry in the country where the training course is held, an invitation letter from LeMar Jet Training s. r. o. can be requested via info@lemarjet.com as soon as possible considering the lead time required by the Embassy for issuing visa. Requests shall contain the following: • training course title and date; • full name, date and place of birth, organization and job title of the participant; • number, date and place of issue, and expiry date of the participant’s passport; • date of arrival in and departure from the country where the training course is delivered; • e-mail address of the participant • evidence of payment of the course fee.
4. LeMar Jet Training s. r. o. will send the invitation letter to Participants subject to the above-mentioned requirements, and the Participants shall submit the invitation letter to the Embassy concerned.
5. Invitation letters will only be sent by courier if the pick-up and delivery are arranged and paid for by the requesting Participant. LeMar Jet Training s. r. o. shall be informed accordingly and pick-up times shall be agreed with LeMar Jet Training s. r. o. in advance.
6. In the event of cancellation either by the Participant or LeMar Jet Training s. r. o., Substitution or Course Transfer, it is the responsibility of the Participant to request for a new letter of invitation at info@lemarjet.com to apply for a new visa at the Embassy.
7. In case of No Show, LeMar Jet Training s. r. o. will inform the Embassy concerned accordingly.
8. In case of Substitution and Course Transfer, an invitation letter will be issued for the new Participant upon request, and the originally-issued letter will be revoked.
9. If LeMar Jet Training s. r. o. cancels a Training Course and offers an alternative Course Date, and the Participant accepts the new Course Date, LeMar Jet Training s. r. o. will provide the Participant with a new invitation letter upon request.

V. Invoices, Payment of Course Fee

1. An invoice is generated and provided to the e-mail address indicated during the online registration process.
2. Payment must be made by credit card or by bank transfer and in Euros, to the bank account of LeMar Jet Training s. r. o. in Slovakia: IBAN: SK22 1100 0000 0029 4914 0869
3. The following data shall be indicated on the bank transfer: -invoice number; -name and organization of the participant; -training course title; -course date.
4. Payment shall be made latest 21 calendar days before the scheduled start date of the Training Course. All payments are considered made as when the amount is credited on the bank account of LeMar Jet Training s. r. o.
5. If the payment is not received in time, you will be charged a collection fee and interest.
6. The Course Fee includes the price of tuition; the Training Course Materials, the LeMar Jet Training s. r. o. Certificate of Attendance (if the participant has attended the course in full) and specifically for classroom courses the fee also includes refreshments during training hours. Accommodation costs are not included in the course fee. Please note that Training Courses are subject to price indexation yearly.

VI. Course Transfer

1. In the event a Participant, who has already paid the Course Fee, wishes to attend the same Training Course on another Course Date, s/he shall transfer her/his seat by sending the request via email to info@lemarjet.com.
2. Course Transfers are only possible to course dates with available seats.
3. Course Transfers can be made free of charge no later than 14 calendar days before the first scheduled day of the Training Course concerned. In the event, the Course Transfer is made within 14 calendar days, but more than 24 hours, before the scheduled start date of the Training Course concerned, a transfer fee of 25% of the full Course Fee will be charged. In the event the Course Transfer is made within 24 hours before the scheduled start date of the Training Course concerned, the full Course Fee will be charged by LeMar Jet Training s. r. o.

VII. Substitution

1. Participants shall only be substituted by Participants who meet the prerequisites for the Training Course concerned, if any, as defined on the LeMar Jet Training s. r. o. website under the respective Training Course.
2. Substitutions may be made until 24 hours before the scheduled start date of the Training Course.

VIII. Cancellation

1. Cancellations shall be made in writing (‘cancellation notice’), by email to info@lemarjet.com. The cancellation notice shall include the following information: invoice number; name and organization of the Participant; Training Course Title; Training Course Date.
2. Upon receipt of the cancellation notice, LeMar Jet Training s. r. o. will send a confirmation to the Participant. Cancellations shall be considered valid only if a confirmation is issued by LeMar Jet Training s. r. o. It is the Participant’s responsibility to monitor if the confirmation notice is received by LeMar Jet Training s. r. o.
3. Cancellation notices shall be received by LeMar Jet Training s. r. o. no later than 56 calendar days for all courses before the first scheduled day of the Training Course concerned. In the event the cancellation notice is received by LeMar Jet Training s. r. o. less than 56 calendar days for classroom courses and for virtual courses, but more than 14 calendar days before the scheduled start date of the Training Course concerned, a cancellation fee of 25% of the full Course Fee will be charged. In the event the cancellation notice is received by LeMar Jet Training s. r. o. less than 14 calendar days for classroom courses and for virtual courses, but more than 3 working days before the scheduled start date of the Training Course concerned, a cancellation fee of 50% of the full Course Fee will be charged. In the event the cancellation notice is received by LeMar Jet Training s. r. o. within 3 working days before the scheduled start date of the Training Course concerned, the full Course Fee will be charged by LeMar Jet Training s. r. o. Please note that LeMar Jet Training s. r. o. keeps the right to cancel training courses until latest 3 weeks (classroom courses) and 1 week (virtual courses) prior to the scheduled start of the training course.
4. Refunds (if applicable) will be made within 30 calendar days after the cancellation is confirmed in writing.
5. LeMar Jet Training s. r. o. adheres to a “cooling-off period” of 14 calendar days for individual consumers only. In case of cancellation communicated in writing within the 14 days of initial registration, a full refund will be paid.

IX. Certificates

1. Participants will be granted an electronic/digital Certificate of Attendance when the course has been attended and paid in full, and an electronic/digital Certificate of Accomplishment, if the participant has opted to obtain it, paid course fee in full, and passed the applicable exam (where applicable) within the maximum number of allowed attempts.
2. In the event, the Participant’s Certificate is lost, or an additional copy is required, a hard copy of the Certificate can be requested from LeMar Jet Training s. r. o. via info@lemarjet.com. Participants will be provided with a copy upon LeMar Jet Training s. r. o.’s receipt of 20 EUR administration fee (excluding postage).

X. Training Courses outside LEMAR JET TRAINING S. R. O. Location

LeMar Jet Training s. r. o. can provide Training Courses upon request outside LeMar Jet Training s. r. o. Location. Requests should be sent to: info@lemarjet.com

XI. Training Course Language

Training Courses scheduled at LeMar Jet Training s. r. o. Location is delivered in English. Selected Training Courses can be delivered in other languages. For detailed conditions please contact info@lemarjet.com.

XII. Intellectual Property

LeMar Jet Training s. r. o. is the owner of, and will retain all rights, title and interest in any and all Course Materials, and in any and all other materials, including any documentation, data, technical information and know-how provided to the Participants by LeMar Jet Training s. r. o. Such information shall not be disclosed or copied to any third parties and shall not be used for any purposes by the Participants or the organization they represent, without the express written permission of LeMar Jet Training s. r. o. All confidential or business-sensitive information provided by LeMar Jet Training s. r. o.’s customers will remain confidential and will not be shared by LeMar Jet Training s. r. o.’s employees or trainers to third parties.

XIII. Liability

1. LeMar Jet Training s. r. o. excludes any and all liability for damages arising out of the failure of a Requesting Person or Organization Representative to provide information to the Participants about the applicable provisions as set out in clause III.2.
2. LeMar Jet Training s. r. o. excludes any and all liability for damages arising out of the failure of a Participant to obtain the necessary VISA in due time.

XIV. Force Majeure

LeMar Jet Training s. r. o. shall not be liable in respect of any failure to fulfill its obligations under this Agreement if such failure is due to reasons or circumstances beyond its reasonable control including but not limited to government interference, direction or restriction, war or civil disorders, strikes, blockade, insurrections, riots, acts of natures, disasters, diseases, epidemics, terrorist actions, or other emergencies.

XV. Suspension from participation

LeMar Jet Training s. r. o. reserves the right to suspend delegates from participation in a training course if their behavior is such that it hampers proper and pleasant delivery of the training course and the performance of the trainer and peers (such as grave misconduct, refusal to comply with house-rules, under influence of alcohol and/or drugs, or other).

XVI. Data Protection

By completing the form on the website, the participant entrusts personal data to the controller in the scope specified in the form. The controller needs all personal data obtained in this manner to implement pre-contractual arrangements (§13 (1)(b) of Act No. 18/2018 Coll. and §16 (1)(h) of Act No. 18/2018 Coll. and Article 6 (1)(b) of EU Regulation 2016/679 on protection of natural persons with regard to the processing of personal data and on the free movement of such data). Over and above the framework of personal data necessary to accomplish contractual arrangements, the participant hereby provides the controller with contact details, which the controller shall maintain in a file with the data specified above. Such contact details are provided to the controller for the purposes of maintaining a marketing database of clients, and for the controller to send information in the future. The participant has the following rights with respect to the controller and the personal data: to request access to personal data, to correct personal data, to erase personal data or to restrict the processing of personal data, to object to the processing of personal data and to request the transfer of personal data. He has the right file a petition to commence privacy proceedings under §100 of Act No. 18/2018 Coll. on Personal Data Protection. Personal data is not transmitted to any third country. The controller processes personal data continuously for the purposes of any future contact from the client and to respond to any additional needs. The controller may, in the future, employ automated individual decision-making processes, including profiling, for marketing purposes. The participant hereby grants LeMar Jet Training s. r. o. as service provider in accordance with §12 par. 1 of Act no. 40/1964 Coll. Civil Code consent to the production and publication of images, audio and audio-visual recordings from the Cabin Crew Intensive Course and their subsequent use to promote the services of the provider LeMar Jet Training s. r. o. to the public, in particular with their publication on the website of the course provider (www.lemarjet.com) or on the social networks of LeMar Jet Training s. r. o. This consent is granted by the person concerned to the service provider with the processing of the following personal data: image (photograph), audio recording, audio-visual recording (video recording). He has the right at any time to revoke this consent to the processing of personal data for the purposes of the controller’s marketing activities. Revocation of such consent has no retroactive effect on the lawfulness of the processing of personal data under such consent prior to its revocation.

XVII. Miscellaneous

Should the person arranging the Registration, Substitution, Course Transfer or Cancellation, or requesting an invitation letter be other than the Participant, LeMar Jet Training s. r. o. assumes that during such processes statements are made on behalf of the Participant and with the authorization to make statements on behalf of the Participant. Questions of an administrative nature or regarding training courses will usually be answered within 48 hours (business days).
